These Terms of Service (the “Terms”) govern your access to and use of the AnytimeBudget mobile application, the website at anytimebudget.com, and any related cloud services (together, the “Service”). In these Terms, “we”, “us” and “our” refer to the operator of the Service. By installing, opening, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
01.Acceptance
These Terms form a binding agreement between you and us. Your continued use of the Service after a revision means you accept the revised Terms. The version in force is the one displayed at this URL.
02.Definitions
In these Terms:
- “Account” means the device-bound installation through which you access the Service.
- “AI Provider” means a third-party operator of an AI model used by the Service to process AI-Assisted Features.
- “AI-Assisted Feature” means any function of the Service that submits your content to an AI Provider for processing, including receipt scanning, voice transcription, image extraction, and document extraction.
- “Content” means the data you input or submit through the Service, including transactions, receipts, voice recordings, notes, and exported files.
- “Subscription” means a paid plan (Plus or Pro) procured through Apple or Google in-app purchase.
- “User” means the individual using the Service.
03.Eligibility
You must be at least 13 years old, or the minimum age required in your jurisdiction to consent to processing of your personal data, whichever is higher. If you have not reached the local age of majority, you also require the consent of a parent or guardian to use the Service.
04.Your account & data
The Service is device-bound: your Content is stored locally within the application, and we do not retain a copy. Our backend processes AI requests and exchange-rate lookups in a streaming, passthrough manner; no per-user records, request histories, quota counters, or logs are retained on our side. You are responsible for the device on which you use the Service, the security of any backups you create, and any actions taken through your installation. We do not operate any account-recovery mechanism for device-resident Content; we recommend you back up regularly using the in-app export.
05.Subscriptions & billing
The Service offers a Free tier and two paid Subscriptions — Plus (HK$8 per month) and Pro (HK$32 per month) — each with monthly allowances for AI-Assisted Features (text, voice, scan, image, file). Allowances reset at the start of each billing period.
5.1 Billing
Subscriptions are sold and billed by Apple through the App Store or by Google through Google Play. The applicable store collects payment at the start of each billing period, and the Subscription renews automatically until cancelled.
5.2 Cancellation and refunds
You may cancel a Subscription at any time through the relevant store account; cancellation takes effect at the end of the current billing period. Refunds are administered by Apple or Google under their respective policies. We do not process refunds for store-billed Subscriptions directly.
5.3 Price changes
We may change Subscription prices. Where we do, we will provide in-app notice in advance, and any change will apply only at your next renewal — never retroactively.
06.AI-assisted features
Receipt scanning, voice transcription, image extraction, and document extraction are powered by AI Providers. These features are best-effort and not guaranteed to be accurate, complete, or fit for any particular purpose. You are responsible for reviewing every AI-extracted result before relying on it for budgeting, accounting, taxation, or any other purpose.
When you invoke an AI-Assisted Feature, your request payload (the receipt image, audio, text, or document) is streamed through our backend to the relevant AI Provider; the response is streamed back to your device. We do not write your request or the response to our storage, and we do not use them to train any model. Each AI Provider's own retention and training policies apply to what it receives. The list of providers is set out in our Privacy Policy.
Nothing produced by an AI-Assisted Feature constitutes financial, tax, legal, accounting, or other professional advice. For decisions that matter, consult a qualified professional.
07.Acceptable use
You shall not:
- Attempt to circumvent any usage allowance, reverse-engineer the Service, or probe its endpoints for unintended uses.
- Submit through the Service any content that is unlawful, that you have no right to upload, or that contains another person's confidential information without their consent.
- Use the Service through any automated system, except where we provide an explicit API and you comply with its documented terms.
- Use the Service in a manner that could disrupt the experience of other users or the integrity of the Service itself.
- Use the Service to develop a competing product or to benchmark for the purpose of building one.
We may suspend or terminate access if we reasonably believe these rules have been breached.
08.Intellectual property
The Service — including the application, this website, branding, copy, and underlying software — is owned by us or our licensors and is protected by intellectual-property laws. Nothing in these Terms transfers ownership of the Service to you.
You retain ownership of your Content. By using an AI-Assisted Feature, you grant us a limited, transient, non-exclusive, royalty-free, worldwide licence to transmit the relevant Content to the AI Provider strictly to process your request and return a result to you. We do not retain that Content, share it beyond the AI Provider, or use it for any other purpose.
09.Disclaimers
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties or conditions of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of AI-extracted results, accuracy of exchange rates, and uninterrupted or error-free operation. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, parts of this clause may not apply to you.
10.Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, arising out of or in connection with your use of the Service, whether based in contract, tort, or otherwise, and even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, and (b) HK$100.
11.Indemnification
You agree to indemnify and hold us harmless from and against any claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any applicable law or the rights of any third party.
12.Termination
You may stop using the Service at any time by uninstalling the application. We may suspend or terminate your access if you breach these Terms, if continuing to provide the Service to you would expose us to legal risk, or if we decide to discontinue the Service. We will provide reasonable notice where it is practical to do so. Sections that by their nature should survive termination — including Sections 8 (Intellectual property), 9 (Disclaimers), 10 (Limitation of liability), 11 (Indemnification), 14 (Governing law), and 15 (General) — shall survive.
13.Changes to these Terms
We may revise these Terms from time to time. The version in force is the one displayed at this URL. Where a revision is material, we will provide in-app notice before it takes effect. Your continued use of the Service after the revision constitutes acceptance of the revised Terms.
14.Governing law
These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to conflict-of-law rules. You and we agree to submit to the exclusive jurisdiction of the courts of Hong Kong for any dispute arising out of or in connection with the Service, except where applicable consumer-protection law in your jurisdiction provides you with a non-waivable right to bring proceedings in your local courts.
15.General
15.1 Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements or understandings.
15.2 Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
15.3 No waiver
Our failure to enforce any provision is not a waiver of our right to enforce it later.
15.4 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation, or sale of substantially all of our assets.
15.5 Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of government, natural disaster, war, terrorism, labour action, interruption of internet or third-party services, or pandemic.
